International Trade Commission confirms Unilin's ITC Ruling

  • On the 16th of September, 2020, the US International Trade Commission (ITC) confirmed the Initial Determination of the 15th of May 2020 rendered by ITC Judge Shaw. All asserted Unilin patents were again considered valid and infringed, and a General Exclusion Order was issued to prevent all importation of PVC based products falling under the Unilin patents without license or other permission.

Mohawk reacts on I4F’s meritless lawsuit


Mohawk is aware that I4F filed a lawsuit in the district court of Delaware accusing Mohawk’s Unipush folddown products of infringing I4F's patent US 10,053,868. 

Mohawk is of the opinion that the ‘868 patent is not infringed and invalid in light of multiple prior art documents that clearly describe what I4F is trying to protect. 

In March of 2019, Flooring Industries, Unilin's IP company, filed an invalidation action against the ‘868 patent at the US Patent and Trademark Office (USPTO) (see press release) because of the clear invalidity arguments.  Mohawk will seek to stay the Delaware suit filed by I4F until there is a decision on invalidity by the USPTO.  Mohawk is confident that the USPTO will decide to invalidate the ‘868 patent, after which the Delaware case should be dismissed.
